Arbitration has historically been one of the most efficient methods of dispute resolution, particularly in the business sector. However, the bureaucracy associated with procedural formalities and the lack of digital standardization have always posed challenges. Now, Portugal is on the verge of taking a significant step towards modernizing arbitration with the launch of a digital platform for commercial and business arbitration by the Porto Institute of Commercial Arbitration (IAC).

This new digital platform is inspired by the Citius model, which revolutionized the management of judicial proceedings in Portuguese courts. It will enable the entire arbitration process – from the submission of initial requests to the issuance of the final ruling – to be conducted digitally.

The implementation of this platform brings numerous benefits for companies and legal professionals who rely on arbitration as an efficient means of dispute resolution. The most noteworthy advantages include:

  • Increased efficiency in proceedings: Digitalization significantly reduces the time required for case processing by eliminating unnecessary bureaucratic hurdles;

  • Cost reduction: Fewer physical displacements, reduced paper usage, and greater administrative efficiency result in a substantial decrease in costs for the parties involved;

  • Enhanced security and confidentiality: Similar to Citius, the platform will be developed with strict cybersecurity protocols to ensure data integrity and protection;

  • Democratization of access to arbitration: The removal of geographical barriers will allow more businesses, including SMEs, to utilize this dispute resolution mechanism.

It is expected that the platform developed by the Institute of Commercial Arbitration will eventually be extended to all other Arbitration Centers, thereby enhancing the efficiency and modernization of arbitration in Portugal. This initiative positions the country at the forefront of innovation in business dispute resolution.
