The question: My children are upset with me, can they stop me seeing my grandchildren?

The Civil Code’s Article 1887-A establishes a right for children to maintain a relationship with their grandparents. The legislator introduced a limit on the exercise of parental responsibilities to prevent parents, without valid grounds, from depriving their children of a relationship with their grandparents.

There is a legal presumption that the child’s relationship with their grandparents is beneficial to them. Therefore, if the parents want to prevent visits, they must prove that this relationship is harmful to the children.

In the absence of any justifiable reason for the lack of contact, the court may establish visits with the aim of safeguarding the best interests of the child.
