In cross-border successions, it is crucial to determine the applicable law and competent jurisdiction under EU Regulation No. 650/2012.

As a rule, the law of the deceased’s last habitual residence applies, unless a valid choice of the law of nationality has been made. Proper coordination between different legal systems, as well as the use of the European Certificate of Succession, may be essential to ensure an effective estate distribution and to prevent disputes among heirs.
