On 28/10/2022, it became possible to carry out authentic acts remotely, by videoconference, by scheduling on the Online Service platform available at www.justiça.gov.pt.
This is a Simplex program measure in a joint effort between the Institute of Registration and Notary Affairs, the Bar Association and the Order of Solicitors and Enforcement Agents.
Now citizens can perform deeds, special transmission procedures, encumbrance, divorce by mutual consent, separation of persons and property by mutual consent, empowerment of heirs, and recognition in person, among other acts that typically could only be performed in person, thus reducing costs and travel for citizens.
For this service, the intervenients must make an appointment on the respective site or with a qualified professional – conservators, lawyers, notaries and solicitors.
In practice, the identity of the parties is verified through authentication on the platform, using the citizen card or the digital mobile key, and through recourse to a biometric system of comparison of the face images collected electronically in real-time with the facial image contained in the information system responsible for the life cycle of the citizen card.
As for the verification of the identity of the professionals accompanying or representing the intervenients, this is carried out with the authentication of the certificates of the respective professional associations.
The documents are digitally signed, it is necessary to have the digital signature active, and the electronic copy and the session recording are kept for 20 years.
In the platform’s reserved area, the user can consult the list of acts in which they are involved (scheduled and carried out), all the inherent details, access the videoconference session page, express consent and will, access and submit documents and proof of payment.
That is an optional measure, continuing to be a service provided in person to citizens.
