The commencement and termination of employment contracts involving nationals of third countries must be notified to the Labour Conditions Authority (ACT), in accordance with the applicable legal provisions and within the relevant statutory deadlines.<\/p>\n<p class=\"isSelectedEnd\">Failure to comply with this obligation constitutes an administrative offence and may be particularly significant in the context of inspections. For this reason, companies should ensure that they have internal procedures in place to guarantee timely compliance.<\/p>\n<h2>What happens if the worker\u2019s documentation expires?<\/h2>\n<p class=\"isSelectedEnd\">One of the situations that frequently gives rise to practical difficulties concerns the expiry of residence permits or other relevant documents during the performance of the employment contract.<\/p>\n<p class=\"isSelectedEnd\">Although responsibility for renewing such documentation primarily rests with the worker, it is advisable for employers to monitor the validity of documents that authorise the exercise of professional activity. The implementation of internal alerts or periodic verification procedures may prove particularly useful in preventing situations of documentary irregularity.<\/p>\n<h2>Workers from the European Union: what should employers verify?<\/h2>\n<p class=\"isSelectedEnd\">The hiring of European Union citizens benefits from the principle of the free movement of workers and, as a rule, does not depend on obtaining a residence permit for the purpose of carrying out a professional activity in Portugal. However, this does not mean that employers are exempt from obligations.<\/p>\n<p class=\"isSelectedEnd\">The obligation to comply with labour, tax and social security obligations applicable to any worker remains unchanged, and employers should verify which social security regime applies in each case.<\/p>\n<h3>Temporary Posting and the Portable Document A1<\/h3>\n<p class=\"isSelectedEnd\">Particular attention should be paid to situations involving the temporary posting of workers from another Member State, in which the social security legislation of the country of origin may remain applicable. In such cases, the Portable Document A1 assumes particular relevance, as it certifies which social security system is competent and prevents situations of double social security contributions. Proper verification and retention of this documentation enables companies to reduce compliance risks and demonstrate the regularity of the situation during any inspection carried out by the competent authorities.<\/p>\n<h2>The risks of non-compliance for companies<\/h2>\n<p class=\"isSelectedEnd\">Employing foreign workers without complying with the legally required conditions may expose companies to significant consequences, including fines and other sanctions provided for by law.<\/p>\n<p class=\"isSelectedEnd\">In addition to the financial impact, failure to comply with documentary and administrative obligations may generate reputational risks, compromise future recruitment processes and create difficulties during inspections conducted by the competent authorities.<\/p>\n<h2>Conclusion<\/h2>\n<p>In a labour market that is increasingly dependent on international mobility, the hiring of foreign workers has ceased to be an exception and has become part of the daily reality of many companies.
