{"id":31248,"date":"2026-02-06T19:09:52","date_gmt":"2026-02-06T19:09:52","guid":{"rendered":"https:\/\/www.caiadoguerreiro.com\/?p=31248"},"modified":"2026-02-06T19:22:22","modified_gmt":"2026-02-06T19:22:22","slug":"kristin-depression-and-state-of-calamity-impacts-on-labour-law-and-the-use-of-the-lay-off-scheme","status":"publish","type":"post","link":"https:\/\/www.caiadoguerreiro.com\/en\/kristin-depression-and-state-of-calamity-impacts-on-labour-law-and-the-use-of-the-lay-off-scheme\/","title":{"rendered":"Kristin Depression and State of Calamity: Impacts on Labour Law and the Use of the Lay-off Scheme"},"content":{"rendered":"<p data-start=\"50\" data-end=\"352\">One of the measures adopted by the Government, after the state of calamity was declared by the <strong data-start=\"145\" data-end=\"169\">Council of Ministers<\/strong> on 29 January 2026, was the reinstatement of the <em data-start=\"219\" data-end=\"239\">simplified lay-off<\/em> scheme, previously used to mitigate the negative effects that the COVID-19 pandemic had on Portuguese companies.<\/p>\n<p data-start=\"354\" data-end=\"546\">The current context once again requires the executive to find mechanisms which, without sacrificing jobs, balance the need to ensure business continuity with the protection of workers\u2019 income.<\/p>\n<h2 data-start=\"548\" data-end=\"599\">What Is the Lay-off (Business Crisis Situation)?<\/h2>\n<p data-start=\"601\" data-end=\"916\">The lay-off scheme is provided for in Articles 298 et seq. of the <strong data-start=\"667\" data-end=\"682\">Labour Code<\/strong> and allows the employer to temporarily reduce normal working hours or suspend employment contracts due to market, structural or technological reasons, catastrophes, or other events that seriously affect the company\u2019s normal activity.<\/p>\n<p data-start=\"918\" data-end=\"1179\">Naturally, companies cannot resort to lay-off for any reason; it must be used as a tool aimed at ensuring the company\u2019s viability and the preservation of jobs, ultimately avoiding the need to file for insolvency or resort to other corporate recovery mechanisms.<\/p>\n<h2 data-start=\"1181\" data-end=\"1258\">Requirements for Access to the Simplified Lay-off and Measures Implemented<\/h2>\n<p data-start=\"1260\" data-end=\"1762\">Access to the simplified lay-off is subject to certain requirements, although less stringent than those imposed by labour law under normal conditions, thus providing a faster route for employers affected by the catastrophe to reduce costs. The requirements that are waived mainly concern the obligation to notify workers of the intention to reduce or suspend work and the negotiation phase between the employer and the affected employees, as provided for in Articles 299 and 300 of the <strong data-start=\"1746\" data-end=\"1761\">Labour Code<\/strong>.<\/p>\n<p data-start=\"1764\" data-end=\"1875\">The access conditions are those laid down in Article 22 of <strong data-start=\"1823\" data-end=\"1851\">Decree-Law no. 31-C\/2026<\/strong>, of 5 February, namely:<\/p>\n<ul data-start=\"1877\" data-end=\"2356\">\n<li data-start=\"1877\" data-end=\"2141\">\n<p data-start=\"1879\" data-end=\"2141\">The employer must be in a situation of business crisis, meaning companies facing economic, financial, or technical difficulties affecting their normal operations \u2014 a request must be submitted on the relevant online platform and via <strong data-start=\"2111\" data-end=\"2138\">Seguran\u00e7a Social Direta<\/strong>;<\/p>\n<\/li>\n<li data-start=\"2142\" data-end=\"2356\">\n<p data-start=\"2144\" data-end=\"2356\">The company must have been affected by the storm, with the applicable geographic scope defined by <strong data-start=\"2242\" data-end=\"2291\">Council of Ministers Resolution no. 15-B\/2026<\/strong>, of 30 January, and <strong data-start=\"2312\" data-end=\"2340\">Resolution no. 15-C\/2026<\/strong>, of 1 February.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2358\" data-end=\"2420\">The employer\u2019s request must include the following information:<\/p>\n<ul data-start=\"2422\" data-end=\"2654\">\n<li data-start=\"2422\" data-end=\"2484\">\n<p data-start=\"2424\" data-end=\"2484\">Economic, financial, or technical grounds for the measure;<\/p>\n<\/li>\n<li data-start=\"2485\" data-end=\"2533\">\n<p data-start=\"2487\" data-end=\"2533\">Staffing structure, broken down by sections;<\/p>\n<\/li>\n<li data-start=\"2534\" data-end=\"2587\">\n<p data-start=\"2536\" data-end=\"2587\">Criteria for selecting the workers to be covered;<\/p>\n<\/li>\n<li data-start=\"2588\" data-end=\"2654\">\n<p data-start=\"2590\" data-end=\"2654\">Number and professional categories of the workers to be covered.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2656\" data-end=\"2964\">Another measure approved, in the form of extraordinary financial support, provides that workers of affected companies receive 100% of their remuneration, up to a limit of two national minimum wages (approximately \u20ac1,840). However, the granting of this support is subject to additional eligibility conditions.<\/p>\n<h2 data-start=\"2966\" data-end=\"3034\">What Obligations Apply to Companies Using the Simplified Lay-off?<\/h2>\n<p data-start=\"3036\" data-end=\"3231\">Under the regime for the temporary reduction of normal working hours or suspension of employment contracts due to business crisis, employers are subject to a set of legal duties and restrictions.<\/p>\n<p data-start=\"3233\" data-end=\"3394\">While benefiting from the simplified lay-off scheme, the employer is subject to the general restrictions contained in Article 303 of the <strong data-start=\"3370\" data-end=\"3385\">Labour Code<\/strong>, namely:<\/p>\n<ul data-start=\"3396\" data-end=\"3729\">\n<li data-start=\"3396\" data-end=\"3462\">\n<p data-start=\"3398\" data-end=\"3462\">Prohibition on distributing profits or dividends, in any form;<\/p>\n<\/li>\n<li data-start=\"3463\" data-end=\"3605\">\n<p data-start=\"3465\" data-end=\"3605\">Prohibition on increasing remuneration or granting any other patrimonial benefit to members of corporate bodies, in the case of companies;<\/p>\n<\/li>\n<li data-start=\"3606\" data-end=\"3729\">\n<p data-start=\"3608\" data-end=\"3729\">Prohibition on hiring new employees for positions that could be filled by workers covered by the reduction or suspension.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"3731\" data-end=\"3746\">A Reflection<\/h2>\n<p data-start=\"3748\" data-end=\"4306\" data-is-last-node=\"\" data-is-only-node=\"\">The <em data-start=\"3752\" data-end=\"3761\">Kristin<\/em> depression represents an exceptional challenge for the Portuguese economic landscape, much like the COVID-19 pandemic did. The use of the lay-off scheme \u2014 particularly the simplified version, with the exceptional waiver of formalities \u2014 emerges as an important legal instrument to mitigate the effects of this crisis on employment.
