This regulation broadens its subjective scope of application to include providers of crowdfunding or lending-based financing services.<\/span><\/h6>\n<div class=\"text-base my-auto mx-auto pb-10 [--thread-content-margin:--spacing(4)] thread-sm:[--thread-content-margin:--spacing(6)] thread-lg:[--thread-content-margin:--spacing(16)] px-(--thread-content-margin)\">\n<div class=\"[--thread-content-max-width:40rem] thread-lg:[--thread-content-max-width:48rem] mx-auto max-w-(--thread-content-max-width) flex-1 group\/turn-messages focus-visible:outline-hidden relative flex w-full min-w-0 flex-col agent-turn\" tabindex=\"-1\">\n<div class=\"flex max-w-full flex-col grow\">\n<div class=\"min-h-8 text-message relative flex w-full flex-col items-end gap-2 text-start break-words whitespace-normal [.text-message+&amp;]:mt-1\" dir=\"auto\" data-message-author-role=\"assistant\" data-message-id=\"bb13f78d-70e7-4b33-9829-703802115edb\" data-message-model-slug=\"gpt-5\">\n<div class=\"flex w-full flex-col gap-1 empty:hidden first:pt-[1px]\">\n<div class=\"markdown prose dark:prose-invert w-full break-words light markdown-new-styling\">\n<p data-start=\"322\" data-end=\"775\">These entities, which were already subject to the Law on the Prevention of Money Laundering and Terrorist Financing (LMLTF), are now required to submit annual information by <strong data-start=\"496\" data-end=\"508\">March 31<\/strong> of each year, referring to the period between <strong data-start=\"555\" data-end=\"584\">January 1 and December 31<\/strong> of the previous year. On a transitional basis, however, the first submission of information under this new regime, relating to the 2025 financial year, may be made until <strong data-start=\"755\" data-end=\"772\">June 30, 2026<\/strong>.<\/p>\n<p data-start=\"777\" data-end=\"820\">The annual information report must cover:<\/p>\n<ul data-start=\"822\" data-end=\"1456\">\n<li data-start=\"822\" data-end=\"984\">\n<p data-start=\"824\" data-end=\"984\">Active and new contractual relationships for the provision of equity or lending-based crowdfunding activities, distinguishing between promoters and investors;<\/p>\n<\/li>\n<li data-start=\"985\" data-end=\"1186\">\n<p data-start=\"987\" data-end=\"1186\">The number of relationships, transactions, and amounts that gave rise to the obligation to report suspicious transactions and other information, in accordance with Articles 43 and 144 of the LMLTF;<\/p>\n<\/li>\n<li data-start=\"1187\" data-end=\"1307\">\n<p data-start=\"1189\" data-end=\"1307\">The structure and size of the activity (turnover, branches, subsidiaries, and any links to high-risk jurisdictions);<\/p>\n<\/li>\n<li data-start=\"1308\" data-end=\"1456\">\n<p data-start=\"1310\" data-end=\"1456\">The communication of money laundering and terrorist financing risks identified by the entity, with reference to the sources of information used.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1458\" data-end=\"1733\">It should be noted that Regulation No. 5\/2025 introduces new fields and detailed elements, strengthening the collection of information on risk classification and review systems, monitoring automation, and processes for assigning risk profiles to clients and counterparties.<\/p>\n<p data-start=\"1735\" data-end=\"2124\">The regulation also introduces a relevant technical change: the transition from the \u201c.DAT\u201d format to the \u201c.XML\u201d format for the electronic submission of reporting files, while also establishing a new file nomenclature and structure. This change aims to optimize the collection and processing of information, enhancing the compatibility and reliability of the data transmitted to the CMVM.<\/p>\n<p data-start=\"2126\" data-end=\"2471\">Finally, it should be recalled that the failure to provide, or the incomplete provision of, the information required by sectoral authorities within the established deadlines constitutes a <strong data-start=\"2314\" data-end=\"2361\">particularly serious administrative offence<\/strong>.
