{"id":16007,"date":"2022-11-18T13:05:05","date_gmt":"2022-11-18T13:05:05","guid":{"rendered":"https:\/\/www.caiadoguerreiro.com\/?p=16007"},"modified":"2023-01-06T13:06:30","modified_gmt":"2023-01-06T13:06:30","slug":"special-measures-to-simplify-public-procurement-in-portugal","status":"publish","type":"post","link":"https:\/\/www.caiadoguerreiro.com\/en\/special-measures-to-simplify-public-procurement-in-portugal\/","title":{"rendered":"Special measures to simplify public procurement in portugal"},"content":{"rendered":"<p><strong><a href=\"https:\/\/dre.pt\/dre\/detalhe\/decreto-lei\/78-2022-203083713\" target=\"_blank\" rel=\"noopener\">Decree-Law no. 78\/2022<\/a><\/strong> is the latest development in the crescent simplification of matters involving public contracts, amending Law No. 30\/2021, which approved special measures for public procurement, the Public Contracts Code and <strong><a href=\"https:\/\/www.sgeconomia.gov.pt\/destaques\/decreto-lei-n-602018-procede-a-simplificacao-de-procedimentos-administrativos-necessarios-a-prossecucao-de-atividades-de-investigacao-e-desenvolvimento-span-classnovo-novospan.aspx\" target=\"_blank\" rel=\"noopener\">Decree-Law No. 60\/2018<\/a><\/strong>, which simplified the administrative procedures necessary for pursuing research and development activities.<\/p>\n<p>Among the measures to expedite and simplify the procedures there is, for example, a new special regime for design-construction work contracts.<\/p>\n<p>In addition, the public contracting regime has been perfected, being further refined and clarified. As such, interpretation issues and doubts relating to the procedures applicable to pre-contractual matters that concern the execution of the Recovery and Resilience Programme have been addressed.<\/p>\n<p>Lastly, some modifications are listed below because they relate to the European directives on public contracting (Directives 2014\/23\/EU, 2014\/24\/EU and 2014\/25\/EU), deserving special attention:<\/p>\n<ol>\n<li>The direct adjustment procedure is now also applicable to proposals considered &#8220;unsuitable&#8221; under the directives;<\/li>\n<li>A reference is introduced to clarify the definition of &#8220;complementary work&#8221;, following the meaning adopted by the directives;<\/li>\n<li>The negotiation procedure and the competitive dialogue procedure are available to deal with situations resulting from &#8220;unacceptable offers&#8221; or &#8220;irregular offers&#8221; in view of the Directives.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Decree-Law no. 78\/2022 is the latest development in the crescent simplification of matters involving public contracts, amending Law No. 30\/2021, which approved special measures for public procurement, the Public Contracts Code and Decree-Law No. 60\/2018, which simplified the administrative procedures necessary for pursuing research and development activities.
