The Portuguese regime for safeguarding and protecting adults does not apply solely to disability cases.

With age comes often risk behaviours or health problems that make it impossible for a person, despite age, to exercise their rights and duties fully and consciously. These can include:

  • Mental illnesses that cause dementia (Parkinson’s, Alzheimer’s, Huntington’s, etc.);
  • Forgetting to take medication;
  • Alcohol and drug abuse;
  • Unconscious squandering of assets (among many others)

For these cases, the law provides a legal frame that allows the adult’s family members to safeguard their well-being and care through the total or partial administration of their assets and the need for prior authorization to carry out certain acts, such as changing doctors or treatment plans.
